Terms and Conditions

Welcome to the Technology Blog from JTV (the “Blog”).  We’ve developed the Blog to facilitate the ongoing conversation about great new stuff in the technology industry. We can’t stop talking about cutting-edge tech news and developments, and we are looking forward to discussing these topics with other tech obsessed folks. The Admins for this site are all members of the Technology team at Jewelry Television, also known as JTV.

We thought it would be a good idea to set out the “rules of the road” for the Blog.   We don’t want to make this a big, complicated deal, but rules are important. And to make a long story short, our lawyers made us do it!  And you know how lawyers can be.  So here goes.

By viewing Blog content or submitting any comment to the Blog, you agree to JTV’s Community Policy.  The JTV Community Policy is focused on discussions concerning jewelry and gemstones. Of course, that limitation doesn’t apply to this Blog.

The JTV Privacy Policy doesn’t apply to posts on or participation in the Blog.

The bottom line is that you’ll need to read this document and the JTV Community Policy before participating in our Blog.  And at the risk of being a little blunt, if you don’t agree to these terms and conditions, you should find another Blog.

Comments or opinions expressed on the Blog are those of the respective contributor(s) only, and do not necessarily represent the views of JTV, its management or employees. JTV is not responsible for, and disclaims any and all liability for the content of the Blog, including without limitation, content created by the members of the JTV Technology Team.

Because the above terms and conditions may change from time to time, you’ll need to check for updates periodically, as you’ll be bound by any revisions.

Let us flesh out the Blog’s ground rules a bit more.  Most of these rules are just common sense, and you’d know how to behave even if we didn’t say a word, but it never hurts to make sure everyone is on the same page.

R-E-S-P-E-C-T. Aretha, the Queen of Soul, should guide you.  Comments must be respectful.  Posts may not be inappropriate, abusive, contain profanity or be otherwise offensive.

Don’t pretend you’re Elvis.  Or anyone else for that matter.  You must not impersonate any other person.

Stay on track. All comments must relate in some way to the post on which you are commenting.

Don’t break the law.  You may not use the Blog to violate local, state, national or international laws.

Don’t hawk products. We’re here to talk, not to hawk. You may not use this Blog as a means to distribute advertising or other unsolicited material to anybody.

Intellectual property.  We respect laws concerning intellectual property. By posting, you represent that you have the right to share the material in your posts, including without limitation, trademarks and copyrighted material.  Jewelry Television®, JTV® and related trademarks, names and logos are the property of America’s Collectibles Network, Inc., which reserves all rights in them, regardless of how they are used on the Blog.

This is a public forum. Anything you post here is out there for the whole world to see.  It may be shared in this forum, or in other worldwide media.

Our servers.  You agree to help with the proper care and feeding of our servers.  You won’t do anything to place an unreasonable load on them or interfere with the operation of the Blog.

We can pull the plug.  We reserve the right to terminate your access to the Blog for any reason at our discretion.  Typically, we’d only do that if you engaged in improper behavior, but there may be other reasons we can’t think of now.

You’ve got our back.  You agree to indemnify us and JTV (and hold us harmless) from all losses, liabilities and damages, including attorney fees, arising, out of your actions related to the Blog.

We’re almost always right, but…  Although we’ll do our absolute best to get things right, we don’t warrant (and neither does JTV) the accuracy or completeness of this Blog, its contents or any linked website.  We also can’t warrant that the Blog will be available every second of every day.  It may go down sometimes, for reasons either planned or a complete surprise to us.  We hate viruses and do everything we can to nuke them until they glow, but we likewise can’t guarantee the Blog’s content will be 100% virus free.

There are limits.  We’ve created the Blog to facilitate discussion about cool tech stuff, and we aren’t rich people. So, we and JTV aren’t liable for any damages, whether they be (brace for lawyer words!) indirect, consequential, incidental, special or punitive.  If you are damaged somehow by the Blog, the most we and JTV can be held liable for is to hand you a crisp $10 bill.  No more.  And if you decide to sue us or JTV for some strange reason, you’ve got to file suit in Knoxville, Tennessee. You can’t sue anywhere else.  So, you should learn how to say “y’all.” Any dispute will be controlled by the laws of the Great State of Tennessee (without regard to conflicts of laws).  This Agreement is the only agreement you have with us, and any invalid section of these terms and conditions can be severed, and the rest will stay valid.

Now, for some general rules about how we’ll handle posts:

  • We will not aggregate comments. All posted comments will be shown separately and not as one.
  • We will make best efforts to respond to comments. That may include a posting that responds to a number of comments or questions on a similar subject. Or, if the question is very specific, it may require additional time to investigate and respond.  We reserve the right to not respond to a comment.
  • All comments will be reviewed before posting and best efforts will be made to post appropriate comments within 48 hours. In our sole discretion, we reserve the right to decide what to post, which includes removing posts and whether we will respond to posts.

Thanks for reading our terms and conditions.  You’ve made our lawyers very happy.  We appreciate that, because they tend to be a grouchy bunch.
